TERMS & CONDITIONS
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all claimants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy of these terms and conditions for your information.
1. Promoter: Fenty Beauty, Kendo Brands, 425 Market Street, San Francisco, CA 94105, USA.
2. Who can enter: The competition is open to all UK 18+ residents and over, including Boots employees, excluding Fenty employees, their immediate families (spouse, parent, child, sibling, grandparent and/or "step" family), agencies or any third party directly associated with the promotion.
3. Who can’t enter: Anyone person with a contract that excludes them from appearing in a brand campaign.
4. By entering the competition, participants confirm that they have read and agree to be bound by these Terms and Conditions and by the decisions of the Promoter.
5. Promotional Period: The competition opens at 00:01 on 15th September 2022 and closes at 23:59 on 31st October 2022.
6. How to enter:
a. Upload a headshot of your face wearing Fenty Pro Filt’r Soft Matte Foundation or other Fenty Beauty products. Photo must not be bigger than 10mb. Please do not wear glasses or a hat. Please do not upload full body photos, these will be disqualified from the competition.
b. Provide your details on the form ( name, date of birth, preferred pronouns, email address, mobile phone number and preferred Fenty Beauty Pro Filt’r Soft Matte Foundation shade).
c. In the box provided, explain in no more than 100 words what Fenty Beauty means to you.
d. In the box provided, explain in no more than 100 words why you are one of the next UK Fenty Faces.
e. Your entry must include and demonstrate the following judging criteria: Reflect the Fenty brand values of fun (25%), Inclusivity (50%), and freedom of looks (25%).
f. There is a limit of one entry per person to the competition. If you enter more than once, your first entry will be accepted, and all others will be disqualified.
g. Incomplete, illegal, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery or receipt. The Promoter
takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.
h. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries or via third parties or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified. If it becomes apparent that a participant is using a computer(s) or multiple aliases to circumvent this condition by, for example, the use of 'script', 'brute force', masking their identity by manipulating IP addresses, using identities other than their own or any other automated means to increase that participant's entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that person's entries will be disqualified, and any award will be void.
i. Entries on behalf of another person will not be accepted, and we cannot accept joint submissions or collaborations.
7. Content restrictions: Entries which, in the Promotor’s sole opinion, breach any of the following restrictions will not be accepted:
a. entries which are sexually explicit or overly suggestive (e.g., graphic nudity or pornography);
b. entries which promote any activities that may appear unsafe or dangerous;
c. entries which feature violent, derogatory, profane, vulgar, indecent, racist, or cruel content, including but not limited to words or symbols that might be considered offensive to individuals of any race, ethnicity, religion, sexual orientation or socioeconomic group;
d. entries which portray the Promoter or Promoter’s brands or products in any way that may give rise to public contempt, scandal, disrepute or ridicule or that defame, misrepresent or contain disparaging remarks about the Promoter or other people or companies;
e. entries which communicate messages or images inconsistent with the positive images and/or brand values associated with the Promoter.
8. Shortlist selection:
a. A shortlist of a minimum of 10 customer entries, and a minimum of 3 Boots’ staff entries, which best meet the judging criteria (in clause 6e) will be compiled by a third-party agency.
b. If your entry is shortlisted, you will be contacted by phone or email to discuss your entry further week beginning 14th November 2022 and asked to submit video with a maximum length of 1 minute by midday 21st November 2022 explaining in further detail what Fenty Beauty means to you and why you are one of the next UK Fenty Beauty Faces.
c. If you are contacted but do not respond within 2 days, you will forfeit your place in the shortlist.
d. The Shortlisted videos must be received by midday 21st November 2022 for entry into the Final Winner Selection.
e. In the event that a shortlisted entrant does not create and submit a video, they will be disqualified from the competition and will not progress to the Final Winner Selection.
f. Video entries must include and demonstrate the following judging criteria: Reflect the Fenty brand values of fun (25%), Inclusivity (50%), and freedom of looks (25%).
9. Final Winner Selection.
a. The shortlisted entries will be judged by a panel which includes at least one person independent to the Promoter.
b. There will be a minimum of five customer winners and a maximum of one Boots employee winner. These winners will be those participants, who in the opinion of the judging panel, best meet the judging criteria in Clause 8f.
c. In the event of a tie between one or more entries, the participant that receives the highest score in ‘Inclusivity’ will be selected as the winner. If a tie still remains, the participant that receives the highest score in ‘Fun’ will be selected as the winner; and so on.
d. The Promoter reserves the right to not award all prizes if there are not enough entries which meet the judging criteria
10. Winner Notification: The winners will be notified week commencing 19th December 2022 by email.
11. Winner Claim:
a. Winners have 10 days to accept their prize. If a winner does not accept the prize within this timeframe, the prize will be forfeited, and if there are enough qualifying entries, awarded to a runner up chosen at the same time as the original.
b. It is the responsibility of the entrants to provide their correct, up-to-date details when entering the competition and/or confirming acceptance of their prize. The Promoter cannot be held responsible for a winner failing to supply accurate information which affects prize arrangements.
12. The Prize:
a. Each winner will participate in a Fenty Beauty UK photo shoot, and the imagery will be used across a Boots advertising campaign
b.Winners will be sent a model release form as a condition of accepting the prize. The form will outline photo usage and timeframe for the usage (maximum two years). There is no payment for participating in the photo shoot nor for use of the photos or the winners’ images. A winner who does not sign the model release form will not be able to participate in the photo shoot and there will be no replacement prize.
c. The shoot will take place in London on one day only between January 2023 and March 2023 (final date to be confirmed).
d. The prize includes economy rail travel and one night’s hotel accommodation in a minimum 3* hotel in London (for the winner and a guest on a room-share basis), travel from the hotel to the photo shoot. Prize also includes breakfast, lunch and dinner for the day of the shoot.
e. The winner’s guest will not be able to attend the photo shoot. Prize excludes additional travel, spending money or personal expenses.
f. Prize winners will also receive a selection of Fenty Beauty products with a minimum of 5 products. There is no product choice
g. The prize is as stated. It is not transferrable and there is no alternative prizing in whole or in part.
h. If a winner is not able for whatever reason to accept their prize, then the Promoter reserves the right to award that prize, if there are enough qualifying entries, to a runner up chosen at the same time as the original.
13. Data Protection:
a. Data processed, basis and purpose of processing
In the context of your participation in the competition, Fenty Beauty, the data controller, will collect and process personal data about you (hereafter, your "Data").
This Data is: your last name, first name, pronoun, email address, phone number, date of birth, Pro Filt’r Soft Matte Foundation Shade and a photo and a video.
This Data is necessary for your participation in the competition and for the awarding of prize.
b. Recipients of the Data
Your Data is processed by Fenty Beauty. It will not be transferred or made accessible to any third party, except for appointed agents to: (i) assist with running the Promotion; and/or (ii) conduct analytics to improve the Promoter’s promotions, products or services. The Promoter (or its appointed agents) will not contact you for reasons other than this Promotion unless you have provided your express consent.
Finally, Fenty Beauty may be required to communicate your Data to third parties when such communication is required by law, a regulatory provision or a judicial decision, or if such communication is necessary to ensure the protection and defense of its rights.
c. Transfers of Data Abroad
The recipients of your Data may be located abroad, including outside the UK. Any transfer of your Data outside the UK Area is carried out with appropriate guarantees, notably contractual guarantees, in compliance with the applicable regulations on the protection of personal data.
d. Data retention
The Data concerning you, collected and processed by Fenty Beauty, will be kept only for the duration of the competition until the prize(s) is (are) awarded to the winners and until the photo shoot for the winners.
However if you consent to receive personilized communication from Fenty Beauty, your email and full name will be kept for 3 years. You can at any time request to no longer receive our communications relating to our offers, news and events. You can in particular use the hypertext link provided for this purpose in each email or communication that we send to you.
e. Your rights
In accordance with the regulations in force, you have the right to access and rectify your Data, as well as the right to request its deletion, to oppose its processing and to obtain its limitation or portability insofar as this is applicable.

14. General
a. The Promoter reserves the right at any time, in its absolute discretion, to: verify the eligibility of any entrant or winner; disqualify any entrant or winner found to be abusing or tampering with the operation of the competition or entering using
fraudulent means, or who the Promoter believes to have acted in breach of these terms and conditions or the spirit of the Promotion; disqualify entrants who do not give correct contact details or those who make an entry on someone else's behalf; disqualify a participant or winner who cannot prove ownership of the submitted entry/photo; disqualify an entrant or winner if they are found to be in breach of clause 3.
b. Where there are reasonable grounds to believe there has been a breach of these terms and conditions prize entitlement will be withdrawn, and if there are enough qualifying entries, awarded to a runner up chosen at the same time as the original.
c. By entering the Promotion, each entrant grants the Promoter a world-wide, irrevocable, non-exclusive, transferable, royalty free and sub-licensable right and licence to use reproduce, modify, adapt, publish or display (in whole or in part) any intellectual property contained in the content of their entry, without royalty, payment or other compensation. Each Participant agrees not to assert any moral rights in relation to such use and warrants that they have full authority to grant such rights.
d. Entrants acknowledge that other entrants may submit entries that may be similar to their own, and that they will not be entitled to any compensation or right to negotiate with the Promoter over such matters.
e. During the Promotional Period, some entries might be shared by the Promoter on its social media feeds. This does not mean that you are a winner, neither does it increase your chances of winning.
f. To the fullest extent permitted by law, neither the Promoter nor agencies involved with this promotion may be liable to the winners, whether arising from tort including negligence, breach of contract or otherwise for any loss or damage whatsoever caused by matters relating to participation in this promotion, or in relation to the award to the extent permissible by law. No compensation for loss of earnings will be paid by the Promoter for participation in any aspect of this promotion.
g. The Promoter reserves the right in its absolute discretion to add or to waive any of these terms and conditions, or to suspend or cancel the promotion at any stage, in the event of circumstances that are unforeseen or beyond its reasonable control (including suspected or actual fraudulent or misleading practices or other breaches of these terms and conditions) with no recompense to entrants.
h. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of the prizing, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
i. Any decision of the Promoter in respect of the Promotion is final in all promotional matters.
j. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to, lost, delayed or not received entries, winner notifications or awards. The Promoter or its agencies will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its agencies.
k. It is a condition of entry that winners’ consent to attending the photo shoot and appearing in Fenty advertising, and sign the model release form; that their entry (including photo) may be displayed on social media sites; to take part in all publicity relating to this competition, including filming and photography, with no further recompense; and give permission for any content generated in which they appear to be featured across all media channels controlled by the Promoter. Winners agree to comply with reasonable requests of the Promoter, and to appropriate behaviour during the photo shoot.
l. The surname and winning entry of the winners will be made available to anyone who requests it by emailing FaceofFenty@loveprizes.co.uk by 31st January 2023. Entrants may request their surname and county is not published in the event they win by emailing FaceofFenty@loveprizes.co.uk before the closing date. However, the Promoter shall provide the surname and county of the winners to competent authorities upon request from such competent authorities (including the Advertising Standards Authority).
m. The laws of England and Wales apply to this promotion, and the English and Welsh courts shall have exclusive jurisdiction over any proceedings in connection with this promotion.
n. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

How long is the Face of Fenty UK competition running?
The competition opens on 15th September 2022 and closes on 31st October 2022.
Who can enter, and what age do you need to be?
Anyone who lives in the UK (England, Wales, Scotland or Northern Ireland) and who is 18 years old or older can enter the competition. Fenty is an inclusive brand, and we want our winners to reflect our philosophy.
Is there anyone who can’t enter this competition?
We are unable to accept entries from anyone under the age of 18. If you already have a contract that excludes you from appearing in a brand campaign, you should not enter this competition.
I work for Boots, can I enter the competition?
Yes, Boots employees can enter the competition. We hope to have one winner who is a Boots employee. If you work for Boots, please include your employee number when you enter.

How many times can I enter the competition?
You can only enter the competition once.
I don’t live in the UK; can I still enter?
Sorry, but if you don't live in the UK, you can’t enter the competition. It’s running in the UK, so only people living in England, Scotland, Wales and Northern Ireland can enter.
Why do you need my email and mobile phone details?
We ask for your contact details in case you are a shortlisted entrant, and we need to contact you. We can only send and receive emails to and from the address given at the point of entry so please be careful when entering your contact details.
What happens to the details I provide?
The information you provide is stored securely and only used by our third-party suppliers for the purpose of this competition and for prize fulfilment.
All details will be securely deleted once the winners have been announced. Your information will be used and held in accordance with Fenty’s Privacy Policy, which is available here
